PLACING ORDERS
Orders may be placed online 24/7 at www.KX-TD.com or by phone during normal business hours. Our normal business hours are MON-FRI from 9AM-5PM (ET) excluding holidays. The holidays that we observe are New Years, Memorial Day, Independence Day, Labor Day, Thanksgiving and Christmas. We close each year for 2 and sometimes 3 days for Inventory. During non-business hours you can contact us via Voicemail, Fax or Email. Please be as clear as possible and leave enough detail so as to ensure a call back the next business day. If for any reason, you choose not to order online and are placing an order by phone, fax or email, be sure to include the following information:

- The shipping address is required in order to ship your order;
- Your email address is used to send your receipt and/or tracking information;

- Your fax number is sometimes needed as a backup to email.
FORMS OF PAYMENT
For online orders via our shopping cart we accept Visa, MasterCard, American Express, Discover and PayPal. If you do not have a credit card, you can send us a check or money order. Mail your check or money order along with a detailed letter listing the items you would like and the shipping destination.
SHIPPING AND HANDLING
We offer inexpensive Ground and Expedited Shipping on all orders within the continental United States, Hawaii and Alaska. Your shipping charge is determined by the weight of the item and your location. For shipping rates, please proceed to our shopping cart where you simulate an order without proceeding to Full Checkout. There are options for Ground, 3-Day, 2nd Day Air, and Next Day Air. You DO NOT have to submit your credit card information or make any commitment before seeing and agreeing to your shipping charges. Corrections made to addresses after shipment will result in a $10 correction fee per box since destination changes are a much more laborious task compared to the original destination entry. KX-TD.COM is not liable for packages that were not delivered on time because of weather, accidents, unavoidable delays or other mishaps including computer glitches by the courier.
PROCESSING YOUR ORDER
All orders are processed and shipped within 1-3 business days. In case the product you selected is on backorder, you will receive immediate notification and be given the choice to remain on backorder, substitute the backordered item for another item or cancel the order.
MISTAKES
We strive to provide accurate and reliable information about our products and services. However, human mistakes do happen and we cannot be responsible for any typographical errors. We reserve the right to cancel orders due to such occurrences. If you are browsing our site and notice something that may seem questionable such as incorrect product information or misspellings, please be kind enough to send us an email at “info@KX-TD.com” and we will do our best to correct it.
ADDRESS VERIFICATION
All orders go through an address verification process in order to protect both you and KX-TD.COM against fraud. We reserve the right to cancel any order(s) that are suspected of being fraudulent.
SIGNATURE REQUIRED
All orders ship to their destination using the “Signature Required” option. This helps to protect both you and KX-TD.COM against fraud. If you prefer that the order be sent using “Hold for Pickup” at the Courier’s Depot, please notify us AT THE TIME you place your order.
RETURN / EXCHANGE POLICY
KX-TD.com is devoted to providing extremely low prices on the latest, brand-new telecom equipment while offering unparalleled customer service, and technical support. All currently manufactured products are new. We also offer (upon request) some older, harder-to-find items, which are obviously not new. This is a service that we provide so that our customers are not forced to purchase a completely new system just because they might need a few hard-to-find parts for their older unit(s).
1. New Products: We believe that it is in every consumer's best interest to know that they are receiving "FACTORY FRESH" products and are not purchasing products that have been re-stocked. Re-stocked equipment (especially telephones) may contain viral and bacterial contaminants passed by others, consequently, we do not resell used equipment. We guarantee to take as much time as necessary to review your product application to ensure that you are receiving the proper equipment.
2. Used Products: If you are purchasing parts for a discontinued or obsolete system or if you are purchasing an entire system from us that is discontinued or obsolete, we pre-test EACH and EVERY item just before we ship the product to you. We do this to avoid unnecessary returns.
3. All Products: Our products contain parts and software that may be easily copied, substituted or contaminated in the wrong hands. Because the potential exists to (a) copy software and then return the item, (b) remove a newly shipped new part and replace it with an older defective part, or (c) accidentally or intentionally contaminate it, we have had to implement a NO RETURN policy. This protective measure has been implemented so that we may continue to offer rock bottom prices to the public without compromising our standards of excellence.
4. Additionally, no returns on any product(s) ordered and/or shipped 10 days before or 60 days after a named tropical storm or hurricane.
We have our customers' best interests in mind, and are happy to REPLACE equipment in the unlikely event* of an "out-of-box" failure. Should out of box failure occur, it must be reported no longer than 5 days after the equipment has been delivered.

Due to overwhelming piracy on software including DVDs, CDs, and Pre-Loaded Data Cards, the manufacturer has stated that these items cannot be returned back to KX-TD.COM. For any issues concerning the software (i.e. Defect, Troubleshooting, etc.), the customer is responsible for contacting the manufacturer directly for assistance.
All KX-TD.COM authorized returns or exchanges missing or with damage to the original box may be refused or may be subject to a 20% penalty fee (i.e. missing/damaged UPC barcodes, missing/damaged manuals, missing/damaged warranties, tape on the manufacturer’s box, etc.). Ship all returns using a traceable shipping method and a separate shipping box. DO NOT put any courier labels on the manufacturer's merchandise packaging. Doing so requires KX-TD.COM to pay for replacement packaging. Therefore, additional fees will be charged under these circumstances. We will not accept items back unless they are returned with the manufacturer's original packaging, placed in a separate outer box. KX-TD.COM is not liable in any way for returned packages that were lost or damaged during shipment.
It is important to know that KX-TD.COM ships from multiple locations. The address on your packing slip may NOT be the same address used for returns and/or exchanges. You are ABSOLUTELY required to obtain a Return Authorization Number from KX-TD.COM prior to returning any item(s). KX-TD.COM is not liable or responsible in any way for packages sent to the wrong address or returned without a KX-TD.COM issued RA Number.
Please include a copy of your receipt along with a description of all problems you had with the packaged components. You should choose a courier that provides tracking and insurance for your package. We do not reimburse shipping and handling costs incurred by either party while processing your order or when returning or exchanging your purchase.
Factory Serviced:
From time-to-time, “Refreshed” products become available. Refreshed products have a “R” designation after the Part Number. There are several reason why we may offer Refreshed products to you.
1. The product is no longer manufactured;
2. The product was previously repaired;
3. The product was purchased but then returned to inventory.
People might return a product for many different reasons. Sometimes they simply don’t understand how to use it. Other times it’s because they purchased too many. Such returns may not be sold as "NEW" and must be sold as REFRESHED.
When a product has been returned, it is fully examined by trained technicians. They evaluate every detail to be sure it meets all performance specifications. If they determine that the product can be refreshed, it is reconditioned or repaired to factory specifications, then cleaned and tested. Only then is it packaged and presented here for purchase.
Note: Some products may have minor cosmetic blemishes and/or may not include small accessories such as belt clips, wall brackets, carry cases, manuals, etc.
Warranties:
The warranty period of all the products we sell is the Manufacturer’s Warranty Period.
¨ Factory Fresh Items: All brand new Panasonic Business Telephone items come with either 1-year or 2-year and many are upgradable to a 7-year manufacturer's warranty.
¨ Refreshed or Factory Serviced Items: Most factory-serviced items come with at least a 30-day warranty, depending on the model.
¨ Special Extended Warranties: All new Panasonic KX-NS Series and KX-TDA50G Telephone System cabinets, power supplies, expansion cards, option cards and Wired & IP telephone are all covered by a 2-year limited warranty. These items also qualify for a 5-year extended warranty upgrade for a total of 7 years of warranty. KX-TVA Series Voice Mail & Automated Attendant Systems and their associated expansion and option cards are covered by a 1-year limited warranty. These items qualify for a 6-year extended warranty upgrade for a total of 7 years of warranty. These products MUST have been manufactured for the U.S. market and not import versions such as Canadian.
Privacy Policy: All information submitted to KX-TD.COM is held in strictest privacy. We simply DO NOT sell customer data to anyone. However, some data may be shared with third parties when necessary. An example of a 3rd party that might need certain information would be your elected IT person, your telephone dial tone or data provider or any bank or leasing institution that has a financial interest in the equipment. Should that ever be necessary, we will only disclose that information that is pertinent at the time. All data collected is secured.
Third-Party Web Traffic Analyzers: We use third-party web analytics to help analyze where visitors go and what they do while visiting our website. These parties may also use anonymous information about your visits to this and other websites in order to improve its products and services and provide advertisements about goods and services of interest to you. Our website is designed to make your shopping experience quick, easy, enjoyable and secure.
Email Offer Subscriptions: Upon placing an order through this web site, you will automatically be enrolled in the KX-TD.COM’s email promotion list unless you opt-out of receiving such communications. We will not share any personally identifiable information, which you have given to us with any third party marketers. Terms of Use and Disclaimer: All content appearing on the KX-TD.COM web site is the sole property of KX-TD.COM, unless specified otherwise. Such material is protected by this copyright included, but not limited to any text and all graphics including images, icons, KX-TD logos and design elements. KX-TD.COM’s website is only to be used for shopping, placing orders or conducting other tasks associated with shopping or placing orders. By placing an order with KX-TD.COM, you acknowledge and agree that at no time is KX-TD.COM making any representation or warranty regarding the products purchased by you the consumer other than those covered under these Terms and Conditions.
Statute of Limitations: The parties agree that any action in relation to an alleged breach of this Agreement shall be commenced within one year of the date of the breach, without regard to the date the breach is discovered. Any action not brought within that one year time period shall be barred, without regard to any other limitations period set forth by law or statute.
Governing Law: The Governing Law shall be KX-TD.COM, INC.’s State of Incorporation.
Venue: Venue shall be the location of KX-TD.COM, INC.’s principal place of business.
Severability: If any provision of this Contract is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Contract shall remain in full force and effect.
Non-Waiver The failure by one party to require performance of any provision shall not affect that party's right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Contract constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
Attorney Fees: In the event of litigation relating to the subject matter of this Agreement, the non-prevailing party shall reimburse the prevailing party for all reasonable attorney fees and costs resulting therefrom.

Entire Agreement:
The final invoice along with any exhibits attached thereto by KX-TD.COM including these Terms and Conditions constitute the Entire Agreement of the parties and supersedes all prior negotiations, agreements and understandings with respect thereto. This Agreement may only be amended by a written document duly executed by both parties.
BY USING THE KX-TD.COM WEB SITE AND/OR ANY SERVICES RELATED THERETO, YOU AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS OF USE AND DISCLAIMER.
